Service Agreements

Specific terms for property management services will be set out in individual service agreements. These Terms supplement but do not replace individual service agreements between HIZ Securities and Clients.

Client Obligations

As a client of HIZ Securities, you agree to:

  • Provide accurate and complete information about your property
  • Make timely payments for services rendered
  • Provide necessary access to properties under management
  • Notify us promptly of any changes affecting the property or service agreement
  • Comply with all applicable laws and regulations
  • Co-operate with us in the provision of services

Fees and Payment

Fees for our services will be set out in individual service agreements. General payment terms include:

  • All fees are quoted in British Pounds (GBP) unless otherwise stated
  • Payment terms will be specified in your service agreement
  • Late payment may result in interest charges as permitted by law
  • We reserve the right to suspend services for non-payment
  • All fees are subject to VAT where applicable

Limitation of Liability

General Limitations

To the maximum extent permitted by law, HIZ Securities shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, or business opportunities
  • Loss of data or information
  • Actions or omissions of third-party contractors
  • Damage resulting from circumstances beyond our reasonable control

Exceptions

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

Professional Indemnity

  • We will return client property and documents upon termination
  • Confidentiality obligations survive termination

Complaints Procedure

As members of the Property Redress Scheme (PRS), we are committed to resolving any complaints fairly and promptly. If you have a complaint:

  1. Contact us in writing with details of your complaint
  2. We will acknowledge your complaint within 3 working days
  3. We aim to resolve complaints within 15 working days
  4. If unresolved, you may refer the matter to the Property Redress Scheme

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website.

Your continued use of our website or services after changes are posted constitutes acceptance of the modified Terms.
